Legal Notice

Thank you for your submissions to Pagewise,Inc's WriteForCash program. Submissions to WriteForCash (whether such submissions are articles or writings, e-mails, ideas, concepts, inventions, know-how, techniques, proposals, projects, plans, processes, reports, drawings, sketches, documentation, discoveries, designs, improvements, or any other type of work product or information) are collectively referred to herein as "Materials," and will be governed by the following terms. Please complete the short form at the bottom of the page and click "submit." This will indicate your understanding, acceptance, and assent to these terms. This Agreement will govern all Materials you submit at any time to Pagewise, Inc.

 

Pagewise, Inc. will notify you regarding the acceptance of your article. Materials may still be rejected if they are construed as inappropriate or poorly executed, which shall be determined at Pagewise's sole discretion. For each Material accepted for publication, you will receive a payment of $15. Checks will be sent at the beginning of the month for all Materials accepted during the previous month. All Materials not accepted for publication shall be discarded or destroyed by Pagewise, Inc., at Pagewise's sole discretion.

 

Should Pagewise accept your article, you hereby agree to assign to WriteForCash, and Pagewise, Inc., the sole and exclusive property rights (including worldwide intellectual property rights) to any and all Materials accepted by Pagewise, regardless of whether the Materials are patentable, copyrightable, or otherwise protected by law, and regardless of the form in which the Materials are provided. You may not sell the material to any other company or individual. No other company may use the submitted version of the Materials without the express written consent of Pagewise, Inc. If the Materials are not purchased by Pagewise, Inc., you shall hold exclusive right to use those Materials for any other purpose.

 

AAs sole owner of such accepted Materials, Pagewise, Inc. shall have the exclusive right to use those Materials for any purpose whatsoever, including without limitation the right to use, copy, publish, display, edit, modify, alter, adapt, distort, make derivative works based on, or make composites of the Materials, or any portion of the Materials, in any manner whatsoever, alone or in conjunction with any other written or artistic material, and in any forms or media now known or hereafter, worldwide and forever (including any renewal terms). Pagewise, Inc. shall have the exclusive right to obtain and hold, in any name or capacity, such copyrights, registrations and/or other protection available in such Materials, and you will provide Pagewise, Inc. with any necessary assistance to obtain or perfect such rights or protections.

 

By submitting any Materials to Pagewise, Inc., you warrant that: (a) you are over 18 years of age or that your parent or guardian has also signed this Agreement and (b) each such Material: (1) is original; (2) has not been previously submitted to any other individual or entity for publication, duplication, or reproduction; (3) will not be submitted to any other individual or entity for publication or duplication unless and until you have received notification from Pagewise, Inc. that the Material has not been accepted for publication; and (4) was created or developed by you acting independently and without the assistance, cooperation, or participation of any other person.

 

You are wholly responsible and accountable for any Materials you provide to Pagewise, Inc. You agree that any information in the Materials is accurate and does not violate any laws nor encourage infringement of any law, and you retain liability for such. You understand and agree that you will defend, indemnify and hold harmless Pagewise, Inc. in the event of any legal action by any party against Pagewise, Inc. based in whole or in part on the Materials (including without limitation trademark or copyright infringement, libel, defamation, or infringement of any right of privacy or publicity).

 

You have read this Agreement and understand and are fully aware of its contents. This Agreement shall be binding on you, and your legal representatives, heirs, successors, and assigns.

 

This Agreement may not be modified or waived except by a written instrument signed by Pagewise, Inc. Pagewise, Inc. reserves the right to void this Agreement at any time, with or without cause, without your consent. This Agreement shall be governed by Texas law, without regard to its conflicts of law provisions. Any portion or segment of this agreement shall not in any manner compromise or invalidate other portions or segments of this formal document. Submission of Materials will indicate your acknowledgment of this Agreement and agreement to the terms. This acknowledgment supercedes all other arrangements.
